Nearly 300 Arrested for DUI over Holiday Weekend

Holidays often involve friends, food, relaxation, and alcohol. Law enforcement authorities are aware of this fact, and increase enforcement efforts during times that people tend to celebrate. These enforcement efforts often involve increased patrols and DUI checkpoints and often result in a significant number of arrests. Anyone accused of a driving under the influence of alcohol or drugs (DUI) in Colorado should retain legal counsel immediately, as a conviction can result in extremely serious legal consequences.7475188766_f839413c93

According to a press release issued the Colorado Department of Transportation (CDOT), increased DUI patrols of the 4th of July weekend resulted in 271 arrests across the state. The agency indicates that 93 law enforcement agencies participated in the statewide crackdown, and the enforcement efforts included sobriety checkpoints and increased patrols, as well as others. The enforcement efforts are part of an ongoing campaign, The Heat is On, which will also include increased DUI enforcement over Labor day and into September.

Aggressive enforcement can lead to poor policing and constitutional violations

While getting drunk drivers off the road is an admirable goal and keeps us all safer, increased enforcement campaigns can lead to over-zealous law enforcement that infringes on people’s rights and false arrests. When innocent people are accused of drunk driving, the consequences can be extremely serious. In addition, violations of a driver’s constitutional rights can often result in the exclusion of evidence, often forcing the state to drop its case against you or your case being dismissed.

The representation of a DUI defense attorney generally has a significant impact on the outcome of a DUI case. There are several procedural and substantive defenses that could potentially be raised, including those detailed below.

  • Challenging the results or validity of any chemical testing that may have been performed – In order to for the results of breathalyzer or other test to be admissible, the test must have been properly performed by an individual who has the appropriate training.
  • Introducing evidence of medical conditions that could explain and observed signs of intoxication – While bloodshot eyes and slurred speech can be caused by intoxication, they can also be caused by a number of other medical conditions as well. In addition, certain medical conditions have the potential to cause inaccurately high blood alcohol concentration readings.

There may be other defenses available as well, so anyone accused of drunk driving should talk to an attorney immediately.
